Sips & Sweets — Terms and Conditions

Last Updated: November 2, 2026

Welcome to Sips & Sweets!

These Terms and Conditions (“Terms”) govern your use of our website, https://sipsandsweets.us/, our mobile applications, and the purchase of products from Sips & Sweets.

By accessing our website, placing an order, or purchasing our products, you agree to these Terms. Please read them carefully before making a purchase.

1. About Sips & Sweets

Sips & Sweets is a Texas-based home bakery specializing in breads, sweet breads, cookies, cinnamon rolls, brownies, muffins, brittle, and fruit and nut pies (such as cherry, apple, and pecan).

We operate under the Texas Cottage Food Production law. Our products are prepared in a private residential kitchen rather than a commercially licensed food establishment. Everyone who prepares our food holds a current accredited food handler certificate as required by Texas law.

Cottage Food Disclosure

THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.

We sell directly to customers through festivals, markets, scheduled pickups, and personal hand delivery by our own team. We do not ship products by mail, and we do not use third-party delivery services or common carriers. We do not sell foods that require refrigeration for safety.

We do not produce or sell meat or poultry products, seafood, ice or ice products (including ice cream, frozen custard, popsicles, gelato, or shaved ice), custard, cream, or pumpkin pies, low-acid canned goods, products containing CBD or THC, or raw milk products.

2. Eligibility and Use of Our Website and Mobile Applications

Our website and mobile applications allow customers to learn about our products, browse available items, locate upcoming events, and place orders when ordering is available.

Online orders are available only for pickup or delivery within Texas. You must be at least 18 years old to place an order. If you are under 18, a parent or guardian must place the order and accept these Terms on your behalf.

By using our services, you agree to:

  • Provide accurate information when placing orders.
  • Use our website and applications only for lawful purposes.
  • Refrain from interfering with website functionality or security.
  • Avoid submitting fraudulent orders or payment information.

We reserve the right to restrict access, cancel fraudulent orders, or refuse service for legitimate business or safety reasons, consistent with applicable law.

3. Products and Availability

All Sips & Sweets products are prepared in small batches, and availability may vary.

We make reasonable efforts to provide accurate descriptions, photographs, ingredients, and pricing. However:

  • Product appearance may vary because our items are handmade.
  • Decorations, sizes, colors, and packaging may differ slightly from photographs.
  • Seasonal and specialty products may be available for limited periods.
  • Product availability may change without advance notice.

We reserve the right to discontinue products, adjust recipes, update pricing, or limit quantities.

Icings: Our cinnamon rolls and similar items may be finished with a shelf-stable powdered sugar icing. Icings described as cream cheese flavored are made with powdered sugar, shortening, and cream cheese flavoring. They contain no cream cheese and do not require refrigeration. Ask us if you would like the full ingredients for any product.

If an ordered product becomes unavailable, we will contact the customer to discuss an appropriate substitution or refund. Substitutions will not be made without customer approval.

4. Labeling and Packaging

All products sold by Sips & Sweets are packaged in a manner intended to prevent contamination and are labeled in accordance with Texas cottage food requirements.

Labels include:

  • The name of our cottage food production operation.
  • Our DSHS-issued unique identification number.
  • The common or usual name of the product.
  • Major food allergens present.
  • The required cottage food disclosure statement.

Customers should review product labels upon receipt. If any required labeling information appears missing or unclear, please contact us promptly.

5. Orders and Payments

Orders may be placed through our website or other authorized Sips & Sweets ordering channels.

All prices are listed in U.S. dollars. Applicable taxes, delivery charges, and other fees will be disclosed during checkout when required.

Payment must be completed according to the payment instructions provided at checkout. An order is considered accepted once Sips & Sweets confirms it.

We reserve the right to decline or cancel an order because of product unavailability, pricing errors, suspected fraud, or circumstances preventing safe fulfillment. If payment has already been collected for an order we cannot fulfill, a refund will be issued for the unavailable items.

Before completing an order, customers will be asked to acknowledge that orders must be received in person, that uncollected orders may be discarded after the holding period described in Section 9, and that they have reviewed the allergen information for their items.

6. Order Cancellations

We understand that plans sometimes change.

  • Customers may request to cancel a standard preorder at least 24 hours before the scheduled pickup or delivery time.
  • Requests received at least 24 hours before the scheduled fulfillment time are eligible for a full refund.
  • Requests received less than 24 hours before the scheduled fulfillment time may not be eligible for a refund.
  • Orders already prepared or in production may not qualify for cancellation or refund if the request is received after the cancellation deadline.
  • Specialty, custom, or made-to-order items may have additional or stricter cancellation requirements. These will be disclosed before purchase, and customers are responsible for reviewing and accepting them at the time of order.

Cancellation requests must be submitted directly to Sips & Sweets through an authorized contact method, including email at sipsandsweets2026@gmail.com. A cancellation is not considered confirmed until acknowledged by Sips & Sweets.

Nothing in this section limits customers’ rights under applicable law.

7. Refunds and Product Concerns

Because Sips & Sweets personally hands orders to customers at pickup, festivals, and local deliveries, customers are expected to inspect their products at the time of receipt.

Customers should verify that the correct products and quantities have been provided and that the products and packaging are in satisfactory condition.

Any concerns regarding missing items, incorrect products, visible damage, or product quality must be reported to Sips & Sweets within four (4) hours of receiving the order.

Concerns reported after this period may not qualify for a voluntary refund, replacement, or store credit.

Customers should provide:

  • Their name and order information.
  • A description of the problem.
  • Photographs of the product, when available and relevant.

We will review the concern and determine whether a replacement, store credit, partial refund, or full refund is appropriate. Refunds are not automatically provided for differences in personal taste or preference.

Approved refunds will generally be issued to the original payment method.

The 4-hour reporting period helps us investigate product concerns promptly. This reporting period does not limit any rights or remedies available under applicable law.

8. Local Pickup and Festival Orders

Sips & Sweets offers designated pickup opportunities, including festival pickup and scheduled local pickup locations.

Customers are responsible for selecting the correct pickup location and arriving during their assigned pickup window. Pickup locations, dates, and times will be provided during ordering or through order confirmation.

Customers should contact Sips & Sweets as soon as possible if they anticipate being late or unable to attend their scheduled pickup.

Missed Pickup Policy

If a customer misses their scheduled pickup window, they must contact Sips & Sweets to arrange an alternative pickup. Alternative pickup arrangements may be available in Lindale, Texas, between 3:00 PM and 8:00 PM, subject to confirmation and availability. Alternative pickup times and locations are not guaranteed and must be approved by Sips & Sweets.

Someone must be present to physically receive the order from us at the time of pickup or delivery. Customers are responsible for collecting their orders within the applicable holding period.

9. Order Holding Policy

When a customer misses a scheduled pickup, Sips & Sweets may hold the order for up to four (4) calendar days following the original scheduled pickup date, provided the products remain safe and suitable for distribution.

For clarity, the four-day period begins on the calendar day after the original scheduled pickup date. For example, an order originally scheduled for pickup on Monday may be held through Friday, subject to product safety and storage requirements.

Certain products may require a shorter holding period or immediate disposal when safe storage cannot be maintained.

Customers must contact Sips & Sweets to schedule an alternative pickup during the holding period. Orders not collected by the end of the applicable holding period may be discarded without refund, except where otherwise required by law.

Sips & Sweets reserves the right to decline redistribution of products that can no longer be provided safely.

10. Local Delivery

Sips & Sweets offers local delivery to eligible addresses within designated service areas. Delivery eligibility is determined by the delivery address or ZIP code entered during checkout.

Personal Delivery. We personally hand-deliver every order using Sips & Sweets team members or household members. We do not use third-party delivery services, common carriers, or shipping companies, and we do not ship.

Free Delivery Minimum

Orders totaling $50.00 or more in eligible merchandise qualify for free local delivery within our designated delivery area. The $50.00 minimum is calculated before applicable taxes and delivery fees and after discounts. Orders below $50.00 may be subject to a delivery fee, which will be disclosed before checkout is completed. Free delivery is available only within eligible service areas.

Delivery Requirements

Customers are responsible for:

  • Providing a complete and accurate delivery address.
  • Selecting an available delivery window.
  • Being available and physically present to receive their order when we arrive.
  • Providing any necessary delivery instructions.

We do not leave orders unattended. If no one is available at delivery, or the address is incorrect or inaccessible, we will contact you once to reschedule. A redelivery fee may apply, or you may collect your order in Lindale within the holding period described in Section 9. Orders not received within that period may be discarded without refund, except where required by law.

We reserve the right to adjust or cancel deliveries because of severe weather, road conditions, safety concerns, or circumstances beyond our reasonable control. If Sips & Sweets cannot fulfill a paid delivery order, we will offer an appropriate alternative or refund.

11. Food Allergies and Ingredient Information

Sips & Sweets takes food safety and ingredient transparency seriously.

Our kitchen handles ingredients that may contain common allergens, including:

  • Wheat and gluten
  • Milk and dairy products
  • Eggs
  • Peanuts
  • Tree nuts
  • Soy
  • Sesame

Major allergens present in each product are listed on its label. Full ingredient information is available on request. Because all items are prepared in a shared residential kitchen, our products may also contain or come into contact with other allergens, including traces of ingredients not listed. We cannot guarantee that any product is completely free from cross-contact, and the absence of an allergen from a label does not guarantee it is absent.

Customers with food allergies, sensitivities, or dietary restrictions should carefully review product ingredient and allergen information and contact us before placing an order to discuss any concerns. If you or someone you are feeding has a severe allergy, please consider whether our products are appropriate.

Customers are solely responsible for determining whether a product is suitable for their individual dietary needs.

12. Products Made Without Added Sugar

Some products are made without added sugar and are sweetened with a monk fruit and allulose sweetener blend. Our brittle also contains isomalt, a sugar alcohol. We do not use erythritol. Sweetener information is available on each product page and on request.

Allulose and isomalt may cause digestive discomfort, including a laxative effect, in some people, especially when eaten in larger amounts. These products still contain flour, nuts, and other ingredients that contain carbohydrates and are not calorie-free or carbohydrate-free. Products finished with powdered sugar icing contain sugar.

We make no health claims and do not guarantee any blood glucose response. Customers managing medical conditions such as diabetes should review the ingredients and consult a qualified healthcare professional.

Any nutrient-content claims are subject to applicable labeling and advertising requirements.

13. Food Storage and Handling

Customers are responsible for properly storing and handling their purchases after receiving them.

Our products are not intended to require refrigeration. For best quality, store items in a cool, dry place, away from heat and direct sunlight, in their original packaging or an airtight container.

Sips & Sweets is not responsible for deterioration caused by improper storage, handling, or exposure to unsuitable temperatures after the product has been transferred to the customer, except where otherwise required by law.

14. Festival and Event Participation

Sips & Sweets participates in local festivals, markets, and community events.

Event dates, operating hours, booth locations, and product availability may change because of weather, event organizer decisions, or other circumstances beyond our control. We do not guarantee that every advertised product will remain available throughout an event.

For prepaid festival pickup orders affected by event cancellation or changes, we will contact customers regarding alternative fulfillment or refunds.

15. Promotional Codes and Gift Cards

Promotional codes cannot be combined, have no cash value, and may be changed or ended at any time.

16. Reviews, Photos, and Customer Content

If you post a review, photo, or tag us on social media, you grant Sips & Sweets a non-exclusive, royalty-free license to share it, with credit where possible, in our marketing. You may ask us to remove it at any time. We will not use photos of identifiable children without a parent’s or guardian’s permission.

17. Website Content and Intellectual Property

Unless otherwise indicated, the Sips & Sweets name, branding, original photographs, written content, graphics, recipes published on our website, and other original materials are owned by Sips & Sweets or used with permission.

Visitors may not reproduce, distribute, sell, or commercially exploit our protected content without prior written authorization, except as permitted by law.

Sharing links to our website or social media content is welcome.

18. Third-Party Services and Payment Processing

Our website and mobile applications may use third-party services for payment processing, ordering, analytics, hosting, and other business functions. (This does not include delivery of your order, which we do ourselves.)

These services may have their own terms, privacy policies, and security procedures. Sips & Sweets is not responsible for the independent actions of third-party providers, except to the extent required by applicable law.

We encourage customers to review applicable third-party policies.

19. Privacy and Customer Information

We respect the privacy of our customers.

Information submitted through our website or applications may be used to process orders, communicate with customers, arrange pickups and deliveries, and operate our business.

Additional details regarding the collection, use, and protection of personal information are provided in our separate Privacy Policy, which is linked on our website and should be read together with these Terms.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Sips & Sweets is not liable for indirect, incidental, special, or consequential damages arising from website use, service interruptions, or purchases.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from negligence where applicable law prohibits such limitations.

21. Events Beyond Our Control

Sips & Sweets is not responsible for delays or inability to perform obligations caused by events beyond our reasonable control, including severe weather, natural disasters, utility outages, supply interruptions, government restrictions, or event cancellations.

When such circumstances affect paid orders, we will make reasonable efforts to communicate with customers and provide appropriate fulfillment alternatives or refunds.

22. Changes to These Terms

Sips & Sweets reserves the right to update or modify these Terms as our business operations, services, or legal requirements change.

Updated Terms will be posted on our website with a revised “Last Updated” date. Changes will apply prospectively and will not retroactively eliminate rights associated with previously accepted orders.

23. General Provisions

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.

Entire Agreement. These Terms and our Privacy Policy are the entire agreement between you and Sips & Sweets regarding your use of our services and purchases.

No Waiver. Our failure to enforce any provision is not a waiver of it.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any disputes arising from these Terms will be handled in accordance with applicable Texas and federal law and brought in the state or federal courts located in the United States, Smith County, Texas.
